The USPS released an advisory in early March, specific the rules around mailing cannabis will loosen up, saying that “some CBD products derived from industrial hemp can be mailable under specific conditions.”

This is to help avoid situations where people attempt to mail THC flower and pass it off as CBD, which is a federal crime.

The memo also indicated that USPS will further relax mailing restrictions in the future, thanks to the passage of the 2018 Farm Bill, which federally legalized industrial grade hemp.

As for now, the current advisory claims that it is legal to mail hemp-derived CBD products in agreement with research-focused provisions of the earlier 2014 version of the federal agriculture legislation.

In order for postal customers to mail hemp through USPS, they must first provide a signed self-certification statement and documentation confirming the hemp producer is licensed through a state agriculture department. The hemp being mailed must also contain 0.3% THC.

USPS stated that the instructions are due to change, given the broader legalization of hemp and its by-products through the 2018 Farm Bill. However, they will not “modify the mailability criteria for CBD and other cannabis products” until the legislation “is fully implemented”.

Agriculture Secretary Sonny Perdue emphasized the importance in progressing regulations and enforcements slowly, given the crops complexity and stated that USDA plans to have its regulations prepared for the 2020 growing season.
