New Mexico state health officials are warning Medical Cannabis dispensaries against selling CBD produced outside of New Mexico or from plants grown outside the state.

CBD, or Cannabidiol, is a non-psychoactive cannabinoid found in Cannabis plants. It is sold in New Mexico dispensaries and some products are combined with other cannabinoids, including THC.

The Santa Fe New Mexican reports that Medical Cannabis Program director Kenny Vigil wrote to dispensaries June 7 that the practice is “in violation of the Lynn and Erin Compassionate Use Act and must cease.”

The purpose of the Lynn and Erin Compassionate Use Act is to allow the beneficial use of Medical Cannabis in a regulated system for alleviating symptoms caused by debilitating medical conditions and their medical treatments.

The act forbids businesses licensed in New Mexico from bringing cannabis or cannabis-derived products into New Mexico. The New Mexico Department of Health says cannabidiol, or CBD, falls into that category.

It was passed in 2007 and forbids business in New Mexico from bringing cannabis or cannabis-derives products into the state. According to the Department of Health, CBD falls into that category.

This is the same issue that the California Department of Health recently pushed. With CBD-only business starting to take away business from licensed dispensaries there has been an uproar. Some owners and local politicians have blamed CBD only stores for lower than normal sales.
